Read a Despatch from the Right Honorable the Secretary of State for the Colonies, No. 112 of 1st August, 1872, relative to Ordinance No. 3 of 1872, to provide for the Oral Examination of Prisoners.
The Honorable PHINEAS RYRIE puts the following Question, which he had handed in after the last Meeting of Council?" Whether His Excellency has any objection to furnish the Council with "some explanation regarding the resignation of Dr. YOUNG, there being a report in the Colony, "that this Officer, (who is acknowledged to have been a most useful and zealous public Servant,) "has been harshly dealt with, and in consequence compelled to send in his resignation."
His Excellency in replying to the Honorable Member, draws attention to the distinction between the functions of the Members of the Legislative Council and those of the Executive Government; and having stated that in his opinion no Member was justified in bringing before the Council any matter based merely on "a report," His Excellency declines to answer the Question. Read, amended and passed, the Rules and Orders for regulating the Practice of the Court of Summary Jurisdiction as framed by the Honorable THOMAS CHILD HAYLLAR, Acting Judge of the said Court, on the 20th August, 1872.
His Excellency moves that the Appropriation Bill for 1873, be read a second time.
Debate ensues.
It is moved by the Honorable PHINEAS RYRIE, and seconded by the Honorable James Greig, that the
second reading of the Bill be postponed for one week.
