9. Should the Purchaser neglect, or fail to comply with these Conditions, his Premium, or any portion thereof which may be paid, shall be thereupon forfeited to His Majesty, who shall be at full liberty either to enforce the Sale, or to re-sell the Property at such time and place, and in such manner as to His Majesty shall seem fit, and in case of a re-sale, the increase, if any, of the Premium or Purchase Money shall be retained by His Majesty, and the deficiency, if any, and all Costs and Expenses shall be made good by the defaulter and be recoverable as liquidated damages, or at the option and pleasure of His Majesty, to re-enter and resume the property as if no sale had ever taken place, in which case also the Premium paid by the Purchaser shall be thereupon wholly forfeited to His Majesty. But such re-entry shall not exonerate the present Purchaser, upon a subsequent re-sale of the property, to make good the deficiency, if any, upon such re-sale, and all Costs and Expenses as ascertained to be recoverable as aforesaid.

10. Possession of the Lots sold shall be given to the Purchaser, and deemed to have been taken by him, on the day of sale.

11. In the event of the Purchaser assigning the benefit of the underwritten Agreement, the assignee shall be bound by the foregoing and following Conditions of Sale, and all powers and remedies shall be enforceable against him to the same extent as if such assignee were the original Purchaser.

SPECIAL CONDITIONS.

1. Additional Crown Rent at the rate of $275 per acre shall be paid for all areas occupied by Buildings erected in connection with the occupation of the Lots as a Farm, such additional Crown Rent in the case of any building to commence from date of com- pletion of such building.

2. The Purchaser will be permitted to train the Stream Course between the points A and B on Sale Plan to such lines and levels and in such manner as the Director of Public Works may approve,

No premium will be charged for any areas of land reclaimed from the stream-bed by such works but Crown Rent, commencing from the date when any area is reclaimed, will be charged for such areas at the rate of $25 per acre, subject to the provisions of Special Condition No. 1.

3. The Purchaser shall have no rights whatever over any of the water flowing in the stream.

4. No drainage from the Lots other than storm water will be permitted to flow into the stream, and the Purchaser must make all necessary arrangements to the satisfaction of the Director of Public Works for the disposal of any foul or contaminated water.

5. The Purchaser shall form an approach path and construct a bridge at the point marked C on Sale Plan to provide access to the cultivated lands on the East side of the stream. The entire work to be subject to the approval of the Director of Public Works and to be executed to his satisfaction.

6. The Purchaser shall defray the cost of compensating the Squatters whose holdings are shewn in yellow on Sale Plan, for the resumption of their holdings and to pay into the Treasury within seven days of the date of a certificate signed by the Director of Public Works, the amount so certified as being due for the above purpose.

7. The exact boundaries of the Lots to be determined by the Director of Public Works before the issue of the Leases and Premium and Crown Rent to be then adjusted in accord- ance with the area and rates at which the Lots were purchased.

8. Possession of the areas at present held by the Dairy Farm Company will be given to the Purchaser on the 26th December, 1907.
