No. 343. It is hereby notified that the execution of letters of request for the examination of witnesses in Japan in cases in which the parties do not wish to be represented at the hearing, is liable to be delayed owing to the requirement of Japanese law whereby the parties to the case must receive due notice of the date fixed for the taking of evidence. In order to avoid this difficulty the Japanese authorities have made arrangements whereby the execution of letters of request can be expedited, provided that they include a statement that the parties concerned will offer no objection if they fail to receive notice of the date fixed for the hearing of evidence.
