No. 11 of 1899, s. 3 (4).

An Ordinance to amend further the Piers
Ordinance, 1899.
Be it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:--
1. This Ordinance may be cited as the Piers Amend- ment Ordinance, 1930.
2. In sub-section (4) of section 3 of the Piers Ordi- nance, 1899, the words " 'In the case, however, of a temporary pier, it shall be lawful" are deleted and the following words are substituted therefor :—
"It shall be lawful, however,"
Objects and Reasons.

"}
The provisions of section 3 (4) of the Piers Ordi- nance, 1899, which permit the Governor in Council to remit the whole or any portion of the rent of a pier is limited in terms to temporary piers. This has proved an embarrassing limitation in certain cases, especially in the New Territories, and is contrary to the spirit of the Crown Fees Ordinance, 1870 (Ordi- nance No. 5 of 1870) under which the Governor in Council is given a general discretionary power to reduce fees.
