Permission is hereby granted to move the above-men- tioned liquors for export in the manner described, on condition that the said liquors shall be immediately moved from the first ship named above to the second ship named above.

NOTE-If the permit is not made use of on the day in respect of which it is issued, it must be returned within 24 hours to the office of the Superintendent of Imports and Exports.

Objects and Reasons

1. This Bill makes certain amendments in the Liquors Ordinance No. 9 of 1911, which experience has shown to be advisable.

2. The definition of "eating house licence is repealed as such licences are now issued by the Head of Sanitary Department. The next amendment in clause of this Bill is due to the fact that spirits alter in weight according to their strength, becoming lighter as the amount of alcohol increases. Absolute alcohol weighs 7.9 pounds per gallon against 10 pounds for pure water. Thus the stronger spirit, being lighter, escapes paying the correct amount of duty payable per gallon. In other words 7 catties of strong spirit is considerably more than a gallon.

The third amendment defines “Person" in the same language as in the Tobacco Ordinance, 1916.

The fourth amendment effected by clause 2 is necessary so as to give an Assistant Superintendent of Imports and Exports the same power as the Superintendent.

3. Clanse 3 of the Bill amends sub-section (1) of section 3 of Ordinance 9 of 1911 by creating the additional offence, as regards any person who has not got a licence under that Ordinance, of having in his possession custody or control any fermenting or fermented material without lawful anthority or excuse.

Another amendment effected by clause 3 of the Bill is in conformity with Government Notification No. 159 published in the Gazette of the 18th March, 1927, which substitutes the Superinte ident of Imports and Exports for the Captain Superintendent of Police.

A similar remark applies to the amendment effected by clause 4 of the Bill.

4. Clause 5 of the Bill amenis section 6 (4) of Ordi- nauce 9 of 1911 by limiting its effect to owners charterers or agents of ships who import any intoxicating liquor solely. for the purpose of export under through Bills of Lading. This amendment will prevent commission agents here, who take orders for the supply of liquor to places outside the Colony, fron continuing to carry on such

business without a licence.

5. Clanse 6 of the Bill simply makes another amend- ment in conformity with the above mentioned Notification in the Gazette of the 18th March, 1927.

6. Clause 7 of the Bill makes an amendment in con- formity with the same Notification.

7. Clause 8 of the Bill repeals references to eating houses the licensing of which is to be dealt with under another Ordinance.

8. Clause 9 of the Bill corrects a clerical error in section 41 (2) (6) of Ordinance 9 of 1911.
