An Ordinance to amend the Hydrocarbon Oils Ordinance,

1939.

BE it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as the Hydrocarbon Oils Short title. Amendment Ordinance, 1939.

2. Sub-section (1) of section 3 of the Hydrocarbon Oils Amendment Ordinance, 1939, is amended by re-lettering paragraph (f) No. 11 of thereof as paragraph (g) and by inserting the following new 1939, s. 3 (1). paragraph as paragraph (f)-

(f) the keeping and use of hydrocarbon oils by persons 18 and 19 intending to use such oils for the purpose of any class of motor vehicles, motor boats, aircraft or engines specified in the regulations, and any such regulations may exempt from the operation of any of the provisions of this Ordinance the keeping and use of hydrocarbon oils by persons intending to use such oils for the purpose of any such class as aforesaid to which the regulations apply;

3. Section 6 of the Hydrocarbon Oils Ordinance, 1939, is amended by the addition of the following sub-sections at the end thereof-

(5) On the landing of an aircraft in the Colony, the fuel No. 11 of and lubricants which are contained in the tanks of the aircraft shall be exempt from duty. No quantity, however, may be unloaded free of duty except temporarily and under the control of the Superintendent.

(6) On departure of an aircraft from the Colony the fuel and lubricants intended for the refuelling or lubrication of the aircraft shall be exempt from duty or alternatively, the duty levied on such fuel and lubricants shall be refunded.

4. Section 30 of the Hydrocarbon Oils Ordinance, 1939, is amended by the addition of the following proviso at the end thereof-

: Provided that this section shall not apply to hydrocarbon oils contained in the fuel tanks or other special compartments and used solely as fuel or lubricants for the engines of the aircraft, ship, motor boat or motor vehicle, and imported in and not removed from such aircraft, ship, motor boat or motor vehicle.
