Such Trade Marks have been used by the applicants in respect of Tinned provisions such as Games, Fish, Fruits, Soy and Vegetables in Class 42 for over a period of fifteen years and that the said Trade Mark (1) has been duly registered in the Republic of China, Singapore, Siam and Annan and the said Trade Mark (2) has been registered in the Republic of China.

The registration of the Trade Mark (2) shall give no right to the exclusive use of the "Chinese National Flag" device.

Facsimiles of such Trade Marks can be seen at the offices of the Registrar of Trade Marks of Hong Kong and of the undersigned.

The Trade Marks have been used by the Ap- plicants m respect of Chemical substances prepared for use in medicine and pharmacy in Class 3.

The registration of "Mendaco" mark shall give no right to the exclusive use of the letter "M" and in use the name or description of the goods appearing on the trade mark varies with the application of the mark to other goods in respect of which registration is applied for comprised in the same class.

The Registration of the Trade Mark (2) shall give no right to the exclusive use of the letters "SMDS".
