(2) In giving any direction under paragraph (1) of this Article the Minister shall have regard to all the circumstances of the case and, in particular, shall secure that the detained person shall not, in respect of any period during which the available part was not wholly paid or applied, be in a worse position than he would have been if he had throughout that period been a detained person having no wife, unmarried wife, eligible child or dependant.
19. Of the detention allowance awarded in respect of a period during which the detained person has no wife, unmarried wife, eligible child or dependant-
(a) such part as is equal to the reserved part of the deten- tion allowance which might have been awarded in respect of the same period if that detained person had throughout that period had a wife may be paid to that detained person or to his personal representatives after that period of detention; and
(b) the remainder may be applied during the period of detention of that detained person for his benefit in accordance with any direction given by the Minister who, in giving any such direction, shall have regard to such circumstances as he may, upon the evidence available to him, consider relevant in not any, the case of that detained person, and the balance, if so applied may be paid to that detained person or to his personal representatives after the end of that period.
20. Notwithstanding anything hereinbefore contained it shall not be necessary to carry to any special account the amount of the reserved part of any detention allowance or so much of any available part of a detention allowance as is not paid under this Part of this Scheme.
21.-(1) Subject to the following provisions of this Scheme, an allowance for the children of a detained person may be awarded in respect of, and paid during, any period falling within the period of detention of that detained person at the following rates :-
(a) For the children under the age limit of a detained person holding an equivalent naval rank which is that of an officer of the Royal Navy--
(i) where part of a detention allowance is being paid to a wife, or unmarried wife of that detained person—
for the first child
for the second child
£20 a year
£15 a year
for the third child
£10 a year
(ii), where no part of a detention allowance is being paid
to the wife, or unmarried wife of that detained person-
for the first child
for the second child
for the third child
£20 a year
£20 a year
£15 a year
£10 a year
for the fourth child ...
(b) for the children under the age limit of a detained
person holding an equivalent naval rank which is that of a
