Enemy territory" means the territory of any State at war with His Majesty, including the colonies and dependencies thereof.

"Property" includes documents of title to pro-

perty.

"Territory in hostile occupation'

means any

territory forming part of His Majesty's ter- ritory, or that of an allied or mentral State, which is or may be in the effective military occupation of a State at war with His Majesty.

3. Every person who is entitled to property of any Returns to description whatsoever in enemy territory or in territory be made. in hostile occupation, or to any interest in any such pro- perty, and every person who has any claim against any enemy person or enemy government, shall within one month after the commencement of this Ordinance, mako a return of such property or claim to the Custodian : Provided that it shall not be necessary to make any such return respecting property or claims whereof returns have before the commencement of this Ordinance volun- tarily been made to the Custodian or to the Foreign Claims Office.

4.--(1) Every person who fails to comply with any Penalties, provision of this Ordinance shall be liable upon sum- mary conviction to a fine not exceeding one thousand dollars and to imprisonment for any term not exceeding six months, and in addition to a further fine not exceed- ing five hundred dollars for every day during which the default continues.

(2.) If any company or other corporation fails to comply with any of the provisions of this Ordinance, the company or other corporation shall be liable upon summary conviction to a fine not exceeding one thousand dollars, and in addition to a farther fine not exceeding five hundred dollars for every day during which the default continues, and every director, manager, secretary or officer of the company or other corporation who is knowingly a party to the default shall on the like con- viction be liable to the like fine, and to imprisonment for any term not exceeding six months.

Objects and Reasons,

1. Under the existing law the following returns have to be made to the Custodian of Enemy Property :

(a) Every person in the Colony who holds or manages any property for an enemy must. make a return of such property; se Ordi- nance No. 22 of 1915, s. 5 (1).

(b) The above provision has been declared to apply to bank balances and deposits held for enemies, and to all debts of $500 or upwards: see Ordinance No. 28 of 1915, s. 6 (1).

(c) Every company which was incorporated in the Colony, or which has a share transfer office in the Colony, must make a return of all shares, etc., of the company which are held by or for an enemy; see Ordinance No. 22 of 1915, s. 5 (2).

(d) Every partner of every firm, a partner of which became an enemy on the outbreak of war, or to which money had been lont by a person who so became an enemy, must make a return of all profits and interest due to such enemy: seë Ordinance No. 22 of 1915. s. 5 (2).
