MISCELLANEOUS PROCEEDINGS No. 69 of 1938.

In the Matter of The Companies Ordi-

nance, 1932.

OTICE is hereby given that by an Order dated the 17th day of December 1938, the Court has directed separate meetings of:-

(1) The creditors of the above named Bank affected by the scheme of arrangement sancti ned by the Court on the 11th day of January, 1936,

(2) The

"A" preference shareholders of the above named Bank,

(3) The B" preference shareholders of the above named Bank, and (4) The ordinary shareholders of the

above named Bank

respectively to be convened for the purpose of considering and, if thought fit, approving with or without modification, a scheme of arrangement proposed to be inade between the said creditors, the "A" preference share- holders, the "B" preference shareholders and the ordinary shareholders of the said Bank respectively such meetings to be held on Saturday the 21st day of January, 1939, at the registered offico of the Bank, No. 8A, Des Voeux Road Central, Victoria in the Colony of Hong Kong, at the respective times below mentioned, namely :-

(1) The meeting of creditors at 10.30

o'clock in the forenoon,

(2) The meeting of the "A" preference shareholders at 11.30 o'clock in the forenoon, or so soon thereafter as the said meeting of creditors is concluded,

(3) The meeting of the "B" preference shareholders at 12.00 noon, or so soon thereafter as the said meeting of "A" preference shareholders is concluded, and

(4) The meeting of the ordinary share- holders at 12.30 o'clock in the after- noon, or so soon thereafter as the said meeting of the "B" preference shareholders is concluded,

at which place and respective times all the said creditors and "A" preference shareholders, "B" preference sharholders and ordinary share- holders are requested to attend.

A print of the said scheme of arrangement can be seen and forms of proxy obtained at the office of the Bank at No. 81. Des Vœux Road Central, Victoria aforesaid, or of their solici- tors, Messrs. Lo and Lo, Alexandra Buildings, Victoria aforesaid on any week day between the hours of 10 am and 5 p.m. prior to the date of the said meetings.

The creditors, "A" preference shareholders, "B" preference shareholders, and ordinary shareholders respectively may attend such sepa. rate meetings as aforesaid and vote in person or by proxy, provided that all proxies given by the creditors, "A" preference shareholders, "B" preference shareholders and ordinary share- holders be deposited with the said Bank at No. 8A, Des Voeux Road Central, Victoria aforesaid not later than 5 o'clock in the afternoon on Friday the 20th day of January, 1939.

The Court has appointed Mr. Choy Hing or failing him Mr. Lam Chi Fung to act as chairman of the said meetings, and has directed such chairman to report the result of the said meetings to the Court.

The above mentioned scheme of arrange. ment will be subject to the subsequent approval of the Court.

́OTICE is hereby given that Cheng Yeung Ling () carrying on the business under the style or firm name of Eng Hua Jam & Co., (R2) of No. 104 First Street, ground floor, Hong Kong, have on the 6th day of December 1938, applied for registration in Hong Kong, in the Register of Trade Marks, of the following series of Trade Marks :—

Such series of Trade Marks have been used by me in respect of Jelly fruit of all kinds in class 42 since the year 1934.

The 'Star" marks are registered as a series of Trade Mark's under Section 26 of the Trade Marks Ordinance 1909 and are associated with one another, and that the registration of the "Star" marks shall give no right to the exclusive use of the firm name Eng Hua Jam & Co." nor of the fruit device appearing on the respective marks.

Facsimiles of the said series of Trade Marks can be seen at the Offices of the Registrar of Trade Marks and of the undersigned.
