Regulation made by the Governor in Council under section 5 of the Ferries Ordinance, 1917, Ordinance No. 28 of 1917, on the 25th day of October, 1928.

It is hereby declared that on the 1st day of November, 1928, section 3 of the Ferries Ordinance, 1917, shall cease to apply to the area mentioned in regulation 1 set forth on pages 755 and 756 of the Regulations of Hong Kong, 1844-1925 under the heading "III. CHEUNG CHAU.", and the said heading and all regulations and matter there- under, set forth on pages 755, 756 and 757 of the Regulations of Hong Kong, 1844- 1925, are hereby rescinded, with effect on such cesser of the application of the said section 3 as aforesaid, and thereupon the following regulations shall be substituted and be in force,-

III. WESTERN.

Application of section 3 of the Ferries Ordinance, 1917.

1.-(1) On and after the 1st day of November, 1928, section 3 of the Ferries. Ordinance 1917 shall apply to the area bounded by the following lines :-

South. The parallel of latitude 22° 9′ North between the points where it is intersected by the meridians of longitude 113° 52' East and 114° 10' East of Greenwich.

West. The meridian of longitude 113° 52′ East of Greenwich between the points where it intersects the parallels of latitude 22° 9' North and 22° 25′ North provided that between the points on the North and South coast of Lantao where the meridian of longitude 113° 52′ East of Greenwich intersects the island, the boundary follows the western coast-line of Lantao and includes the waters appertaining thereto.

North.--The parallel of latitude 22° 25′ North from its point of inter- section with the meridian of longitude 113° 52′ East to its point of intersection with the mainland, North West of Castle Peak, thence in a south and easterly direction by way of Castle Peak and Tsun Wan along the shore as far as the point of intersection of meridian 114° 10′ East of Greenwich with the shore near Mong Kok Tsui. East. The meridian of 114° 10' East of Greenwich between its points of intersection with the shore near Mong Kok Tsui and with the south shore of the Harbour near the Royal Naval Yard. Thence along the southern shore of the Harbour in a westerly direction, and along the western shore of the island as far as its intersection with the same meridian, and thence along that meridian as far as its point of intersection with the parallel of latitude 22° 9′ North.

(2) This declaration shall not have the effect of prohibiting the maintenance of any ferry between any single point within the said area and any point or points outside the said area.

Licences.

2. The grant of any licence under the Ferries Ordinance, 1917, for the exclusive maintenance of ferries within the area declared and described in the forego- ing regulation 1, without public tender, is hereby authorised.

3. The grantee, the term for which the licence shall be granted and the conditions and stipulations of grant and issue of any licence as mentioned in the fore- going regulation 2, and the nature and amount of the security in respect thereof shall be in the absolute discretion of the Governor in Council.

4. Regulations 1, 4, 5, 6, 7, 9, 10, 11, 12 and 14 appearing under the heading "I-CENTRAL" on pages 744 to 754 of the Regulations of Hong Kong, 1844-1925, hereinafter referred to as the principal regulations, are inapplic- able to the area described in the foregoing regulation 1 and to licences granted under these regulations.
