No. 892.-The following Bill was read a first time at a Meeting of the Council held on the 25th October, 1906:-
A BILL
ENTITLED
An Ordinance to amend the Widows' and Orphans'
Pension Fund Ordinance, 1909.
Be it enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows
1. This Ordinance may le cited as the Widows' and Orphans' Peusion Fund (Amendment) Ordinance, 1906, and shall be read and construed as one with the Widows' and Orphans' Pension Fund Ordinance, 1900, hereinafter called the Principal Ordinance.
2. The definition of “ Salary" in section 2 of the Prin- cipal Ordinance is hereby repealed and the following defini- tion is substituted therefor :-

Salary means the salary of a public officer's sub- stantive appointment or appointments including personal allowances equivalent to salary."
3. Section 9 of the Principal Ordinance is hereby repealed and the following section is substituted therefor :-

9.—(1.) From and after the commencement of this Ordinance, subject to the provisions of section 35, a monthly abatement of four per centum shall be made from the salary or pension, as the case may be, of every existing contributor to the Fund, and of every officer hereafter ap- pointed, who shall have been engaged in Eng- land, or who shall have been engaged in the Colony and shall have served for three years, and of every member of the Police Forte who has attained or may hereafter attain the rank of sergeant or any higher rank, and all such abatement shall be credited to the Fund, provided that in the ease of an officer holding or having held a post the salary of which is on a sterling basis, the abatement shall be made and credited to the Fund in dollars at four per centum of such sterling sakry or pension cou- verted into dollars at the rate fixed from time to time by the Government for the payment in the Colony of such salaries or pensions. Pro- vided further that such contributions shall cou- tinue to be made and credited to the Fund on the full salary whenever an officer is on leave of absence with half salary or without salary, (2.) Contributions made to the Fund by officers holding or having held posts, the salary of which is on a sterling basis, shall, for the purpose of calculating pensions, be deemed to be fixed sterling contributions, and the pensious shall accordingly be fixed and payable in ster- ling, or if paid in the Colony, shall be converted into dollars at the rate from time to time fixed by the Government for the payment in the Colony of officers' pensions.
(3.) The abatement of four per centum from the salaries and pensions of public officers shall be made by the Treasurer, or in case of payments made by the Crown Agents, by the Crown Agents on each occasion of payment of salary or pension and shall be placed to the credit of the Fund; provided always that :- (a.) When a contributor on leave of absence is paid by the Crown Agents, he shall be entitled to receive only ninety-six per cont. or forty-six per cent, of his nominal salary, according as he is on full or half pay leave, converted (in the case of dollar salaries) into sterling at the rate of exchange at which such contributor is entitled to receive such salary.
