By-law made under Section 16 of the Public Health and Buildings Ordinance, 1903,- (Ordinance No. 1 of 1903).

By-law No. 3 contained in Schedule B of the Public Health and Buildings Ordinance, 1903, and published on page 33 of the Regulations of Hongkong under the heading "Offensive Trades is hereby repealed and the following by-law is substituted there-

for:

3. (1.) Every application for a licence shall be made in the form attached to these by-laws. Subject to the provisions of sub-section (2) of this by-law the person so applying shall, if the Board approves, receive a licence from the Board in the form attached to these by-laws, and such person is hereinafter referred to as the licensee and shall be responsible for the due performance of the provisions of these by-laws. Every licence shall expire on the 31st December and shall be for a period not exceeding one

year.

(2.) No such licence shall be issued by the Board until it is satisfied that a licence issued by the authority of the Governor under the Crown Lease of the premises to be registered has been or will be granted or until a certificate has been signed by the proper officer to the effect that no such licence is required.

(3.) Every application for a licence from the Governor under the Crown Lease shall be made by or on behalf of the person registered in the Land Office as the owner of the premises in respect of which a licence is applied for to the Head of the Sanitary Department at the same time that an appli- cation is made for a licence from the Board under by-law 3 (1).
