A BILL

Short title.

An Ordinance to provide for declarations of ultimate destination in respect of goods wares and merchandise to be exported to certain places and for the furnishing of export manifests.

BE it enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as the Declarations of Ultimate Destination Ordinauce, 1915.

2. In this Ordinance :-

(1.) "To attempt to export means to do any act preparatory to or for the purpose of exporta- tion.

(2.) To export" means to carry out of the Colony or to cause to be carried out of the Colony, and includes the carriage out of the Colony of things which were carried into the Colony by water and which are, without transhipment into any other vessel, carried out of the Colony on the same vessel on which they were carried into the Colony.

(3.) "Person", except so far as relates to the imposition of the penalty of imprisonment, includes a body corporate and a firm.

(4.) "Ship" has the same meaning as in the Mer-

chant Shipping Ordinance, 1899.

4. Such permit shall be in the form contained in the Second Schedule hereto.

5. The Superintendent of Imports and Exports shall not issue any such permit until (a) there shall have been dependent on presentation presented to him a declaration of ultimate destination with respect to such goods wares and merchandise and (b) the person applying for such permit shall have answered to his satisfaction all enquiries with respect to the said goods wares and merchandise.

6. Such declaration of ultimate destination shall be made by a statutory declaration which shall be in the form contained in the Second Schedule hereto.

7. Such declaration of ultimate destination shall be made by the actual exporter, or by some responsible repre- sentative of the actual exporter, or in the case of a limited company by a director secretary manager or other respon- sible officer, having a personal and first-hand knowledge of the enquiries made and of the facts stated in the declaration, and carrying agents as such shall not be regarded as competent to make any such declaration.

8. Subject to the provisions of section 5 of this Ordi- nance, the issue of any such permit shall be in the absolute discretion of the Superintendent of Imports and Exports.
