"Food Factory" means a place where food is prepared for sale and includes bake-houses, food preserving establish- ments and aerated water manufactories;
'Food Officer means any person appointed by the Proper Authority on the recommendation of the Director of Medical Services for the purposes of these rules;
"Food preserving establishment" means any business, undertaking or concern which carries on the trade of food preserving, or any of the branches of such trade, such as the making of sugar confectionery, cocoa, chocolate, jam, marmalade, preserved fruits, Chinese preserves, fruit and table jellies, meat extracts, meat essences, sauces and pickles; the preparation of meat, poultry, game, fish, vegetables and fruit for sale in a preserved state and the processes of wrapping and filling, and packing other than the packing of the finished article in cases or crates merely for storage or transport;
"Health Officer' includes the Director of Medical Services, any medical officer appointed as a Health Officer by the Governor, any Colonial Veterinary Surgeon and any officer for the time being performing the duties of a Health Officer;
"Public Market" means a market which has been declared a market by the Governor in Council or may here- after be declared a market by the Governor in Council under section 6 (2) (a) of the Ordinance;

Market Area
means the area which has been declared by the Governor in Council to be the area to be served by any market or may hereafter be declared to be the area to be served by any market under section 6 (2) (b) of the Ordinance;
"Milk includes cream and skimmed and separated milk, but does not include imported preserved milk;
"Milk shop" includes any premises on which fresh milk is sold in the properly closed and unopened receptacles in which it was delivered to the premises, but does not include a shop or other place in which milk is sold for consumption on the premises only;

Proper Authority
means the District Officer North for the Northern District or District Officer South for the Southern District of the New Territories, unless some other authority is indicated;

Restaurant means a building or portion thereof used as an hotel, eating house, tea house or other similar establish- ment and having a licence for the sale of intoxicating liquors;
"Technical services" include inspections, examinations, taking of samples, seizures, prosecutions and all other duties of a supervisory nature carried out by Health Officers and Food Officers under these Rules;
*Sale* or "Sell" includes barter and also includes offering or attempting to sell or receiving for sale or having in possession for sale or exposing for sale or sending or delivering for sale or causing or allowing to be sold, offered or exposed for sale, and refers only to sale for human consumption or use;
