12. Every person having the custody or control of metals shall protect and keep them safe from unusual damage or deterioration.

13.-(1) It shall be lawful for the Metals Controller to cause to be served upon any person a notice substantially in Form G in the Second Schedule to this order declaring such person to be a licensed dealer in metals and thereupon such person shall be deemed to be a licensed dealer for the purposes of this order and shall within twenty-four hours make due application to the Metals Controller to obtain a licence as set forth in sub-paragraph (1) of paragraph 3 of this order.

(2) Service of a notice under this paragraph may be effected as follows-

(a) when the person to whom the notice is addressed is an individual or a firm, by serving the same personally upon such individual or upon a partner in such firm, or upon any adult person appearing to the person effecting service to have charge of, or to be employed in, the business of such individual or firm: Provided that, for the purposes of this sub-para- graph, a notice shall be deemed to be personally served if it is left with or near the person to be served and if his attention is drawn to it by the person effecting the service;

(b) when the person to be served is a company, by leaving the same at the registered office of such company.

(3) Every person effecting the service of a notice under this paragraph shall indorse upon a duplicate copy thereof the time, date and manner of such service and shall sign such indorsement and return such duplicate to the Metals Controller,

14. For the avoidance of doubt, it is hereby declared that the issue to any person of a licence to import metals under any order or regulation providing therefor shall not exempt such person from compliance with the terms of this order.

15.-(1) The issue of permits under this order shall be within the absolute discretion of the Metals Controller.

(2) Every person, firm or company to whom any permit has been issued under this order shall produce such permit on demand to the Metals Controller or any person authorized by him in writing to demand the production of permits.

16. For the purpose of this order a contractor or sub- contractor who is carrying out any work shall be deemed to be in possession of any metals which are at the site of such work and which have been provided by him for such work until such time as they are incorporated in the work.

17. Subject to the provisions of paragraph 16, this order shall not apply to His Britannic Majesty's forces, or to any department of the Government of Hong Kong or to any person, officer or authority from time to time exempted from the provisions of this order by notification in the
