In exercise of the powers conferred by the Emergency Powers (Defence) Acts, 1939 and 1940, as applied to this Colony by the Emergency Powers (Colonial Defence) Order in Council, 1939, and the Emergency Powers (Colonial Defence) (Amendment) Order in Council, 1940, His Excellency the Governor makes the following regulations---

The Ships' Guards (Anti-sabotage) Regulations, 1941.

1. These regulations may be cited as the Ships' Guards Citation. (Anti-sabotage) Regulations, 1941.

2. The owners, agents or charterers of any ship, Owners, whether British or foreign, shall, while such ship is in the etc., to provide waters of this Colony, provide at their own expense such ships' guards, hereinafter called "ships' guards", as the Commis- guards. sioner of Police may direct and for the maintenance of such guards while on duty and for their transport to and from duty.

3. The Commissioner of Police may make rules for the government, equipment, pay and discipline of ships' guards and by such rules may provide for fines, not exceeding ten dollars, for breach of such rules.

4. Any money due under the provisions of regulation 2 by the owner, agent or charterer of any ship in respect of of money any ship's guard shall be paid to the Commissioner of Police and shall be deemed to be a debt due to the Crown recover- able under the Crown Remedies Ordinance, 1875, on a Ordinance certificate under the hand of the Commissioner of Police.

Powers of ships'

5.-(1) Any ship's guard on duty on any vessel may- (a) search any person boarding or leaving the vessel and guards. the effects or baggage of such person;

(b) if he has reasonable grounds for suspecting that there is to be found in the vessel evidence of the commission of a war offence, search the vessel and anything therein;

(c) seize any article which he has reasonable ground for believing to be evidence of the commission of any war offence.

(2) Any ship's guard acting in the course of his duty may arrest without warrant any person whom he has reason- able ground for suspecting to have committed a war offence.

(3) Any article seized and any person arrested by a ship's guard shall be taken forthwith to a police station to be dealt with according to law.

(2) Before removing any person arrested or any article guards. seized from a ship, a ship's guard shall deliver a written report to the master of the ship, giving the name of the person, a description of the article and such further particulars as may be prescribed by rules under regulation 3.
