ORDINANCE No. 10 of 1899. (MERCHANT SHIPPING).

In exercise of the powers conferred on him by section 32 (2) (b) of the Merchant Shipping Ordinance, 1899, His Excellency the Governor in Council amends Table P. in the schedule to the said Ordinance as appearing on page 352 of Volume I of the Regulations of Hong Kong (1937 edition).

Amendment.

After regulation 4 in Table P is inserted the following proviso:

Provided that:

1. Exemption from payment of Light Dues is, in future, to be granted to a ship, whether forcibly diverted into port or not, provided

(a) none of the cargo is seized; and

(b) the call at the port is not in the normal course of trade or business, and cargo, passengers, or mails are not landed or loaded.

If exemption is allowable, the Light Dues, if paid, may be refunded.

2. Liability to payment of Light Dues is incurred

(a) if the whole, or any part, of the cargo of a ship, whether forcibly diverted or not, is seized; or

(b) if, to enable the ship to proceed, a shipowner elects to unload cargo in the Colony pending the result of inquiry as to seizure, whether or not the whole or part of the cargo is ultimately ordered to be seized.

In either case, clearance is to be refused until payment has been made.
