No. S. 38.- Sealed tenders in triplicate, which should be clearly marked Tender for Ferry ", are hereby called for, and will be accepted at the Colonial Secretary's Office until Noon on the 19th day of February, 1937. Each tenderer should deposit with the Colonial Treasurer the sum of $50 as a pledge of his good faith and should forward the receipt therefor with his tender to the Colonial Secretary's Office. Deposits will be returned to unsuccessful tenderers.

The tenders are required for the provision of a ferry service for passengers and goods between Tap Mun, on Grass Island, in the Northern District of the New Territo- ries, and Tai l'o, in the same District, for a period or term of 5 years, beginning on the 1st day of March, 1937.

The service will be subject to the following conditions:-

(1) that the vessel employed is approved by the District Officer, and is duly

licensed;

(2) that the ferry adheres to a schedule approved by the District Officer.

(3) that all directions given by the District Officer as to terminal and inter-

mediate places or ports of call are complied with;

(4) that the fares and charges at any time taken and made are approved by

the District Officer; and

(5) that a sum of $156 a year, to be paid quarterly in advance, is paid to the Manager of the Kowloon-Canton Railway, British Section, in respect of the use, at times specified under condition (3) above, of the Government Pier at Tai Po.

The successful tenderer will be required to deposit with the Colonial Treasurer a sum of $500, all er part of which may be forfeited by order of the District Officer, North, subject to appeal to the Governor in Council, for failure to observe any of the above- mentioned conditions. The $50 originally deposited will be deducted from the said deposit of $500, making the further addition of a sum of $450 only necessary.

The Governor in Council will be asked to exclude the successful tenderer's ferry from the operation of the Ferries Ordinance, No. 28 of 1917, subject to the conditions set out above.

The Government does not bind itself to accept the lowest or any tender.
