An Ordinance to amend the Opium Ordinance,

1909.

BE it enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as the Opium Amend- ment (No. 2) Ordinance, 1910, and shall be read and construction. construed as alle with the Opium Ordinance, 1909,

2. The proviso to section 49 of the Principal Ordinance is hereby repealed.

3. Section 34 of the Principal Ordinance is hereby repealed and there shall be substituted therefor the following section :—

“54.—(1.) On the importation of morphine or any com- pound of opium by a liccusco under sectious 51 and 53 of this Ordinance the said licensee or in cases where the licensee is a limited company the manager thereof shall before applying for or taking by himself or his servants delivery of the morphine or com- pound of opium make a declaration before the Superintendent stating the nature and amount of the goods to be imported.

(2.) Any person required to make a declaration under this section who fails to make a declaration or who makes a false declaration shall be guilty of an offence against this Ordinance."

Memorandum,

This Bill amends the Opium Ordinance, 1909, by providing that the declaration on the importation of opium, in the case of a limited company, shall be taken by the manager before taking delivery by himself or his servants. It also makes the failure to make such a declaration an offence against the Ordinance.
