Memorandum.
The primary object of this measure is to transfer from the Justices of the Peace to a Licensing Board consisting of seven Justices of the Peace the control of publican's and adjunct licences, with a view to ensuring continuity of policy in the control of publican's and adjunct licences and to effecting reform in the existing Public House System.
The requirement of the Principal Ordinance that a licensee shall enter into a recognisance is repealed, as any breach of the conditions mader which a beence is held can be fully dealt with under sections 38 and 39 of the Principal Ordinance.
Adjunct licences are now divided into two classes, viz., Hotel Keepers' Adjunct Licences" and "Restaurant Adjunct Licences", the definitions of which are given in section 2.
By the same section Wholesale and Grocers' Licences are done away with and in lieu thereof is substituted a licence to be called a "Dealer's Licence”,
Section 3 prohibits the sale and importation of liquor on commission without a licence.
Section 6 of this Ordinance gives the Governor-in- Council power to make such regulations as he may think fit, for the purpose of controlling the business carried on by the holder of a publican's or an adjunet licence.
Section 11 empowers the Governor-in-Council to regulate the standard of quality of all intoxicating liquors sold in the Colony.
The conditions of a Publican's Licence are given in section 15 and those of Restaurant Adjunct Licence and Hotel Keeper's Adjunct Licence in section 16 and Form No. 10A respectively.
Under section 19 the Governor-in-Council is given power to transfer the duty of issuing and renewing licences from the Colonial Secretary to other officers.
The Second Schedule provides for a new Scale of Fees.
