Rules made by the Governor-in-Council under Section 3 of the New Territories (Regulation) Ordinance, 1899, (Ordinance No. 8 of 1899), this 6th day of August, 1909.

LIQUOR LICENCES IN THE NEW TERRITORIES EXCEPTING NEW KOWLOON.

1. The expressions "New Territories" and "New Kowloon" have respectively the meanings assigned to them by Section 2 of the New Territories (Extension of Laws) Ordinance, 1900.

The expression "Northern District" means that portion of the New Territories called or known as the Northern District as defined by the Order-in-Council dated the 26th day of April, 1909, and published in Government Notification No. 263 of 1909.

The expression "Southern District" means that portion of the New Territories called or known as the Southern District as defined by the Order-in-Council dated the 26th day of April, 1909, and published in Government Notification No. 263 of 1909.

2. No person shall sell or permit to be sold any Chinese or European Wines or Spirits, and no person shall distil or cause to be distilled any Spirits in the New Territories, except- ing New Kowloon, unless :—

(a.) Such person takes out an appropriate licence for the same in the form refer-

red to in these Rules; and

(b.) Such licence is duly paid for; and

(c.) The conditions on such licence are complied with.

3. Such licences shall be granted in respect of the Southern District by the Captain Superintendent of l'olice and in respect of the Northern District by the District Officer.

Such licences shall be in the forms and shall contain the conditions respectively set forth in Schedules A, B, and C to these Rules, and shall expire on the 17th day of April in each year.

4. The fees payable in respect of such licences shall be the fees specified in Schedule D to these rules, and such fees shall be paid to the Colonial Treasurer or to such officer or officers as he may depute for that purpose.

5. The Captain Superintendent of Police or the District Officer, as the case may be, or his authorised representative may issue to persons holding licences under these Rules tempor- ary liquor licences free of charge for such periods and subject to such conditions as he may think fit.

6. If any licensee commits a breach of any of these Rules, his licence may be forfeited and cancelled by the Governor-in-Council, in addition to any other penalty to which he may be liable by law.

7. The Rules made by the Officer Administering the Government-in-Council on the 3rd day of June, 1902, and published in Government Notification No. 356 of 1902 and the Order made by the Governor-in-Council on the 16th day of October, 1903, and published in Government Notification No. 690 of 1903, are hereby rescinded.

Police Station.
