of a body contrary to this Ordinance or who shall neglect to observe the precautions pre- scribed as the condition of the licence for removal shall for every such offence be liable to a penalty not exceeding two hundred dollars.
Provided always that nothing herein con- tained shall be deemed to affect the right of a Magistrate to order the exhumation of a body for the purpose of holding an inquiry into the cause of death of any person.
(4.) No such licence shall be granted in respect of any grave on land held under lease from the Crown without the written consent of the Crown Lessce or his duly authorised agent. 918.-(1.) It shall be lawful for the Governor, whenever he shall deem it expedient for the exceution of any public work or any public purpose to remove any grave or graves on Crown land, whether in au authorised gemetery or elsewhere, by order under his hand to direct such removal to be made in such manner as he shall think fit. (2.) No such order shall be made in respect of graves situated in an authorised cemetery until six months' notice of the intention to make it shall have previously been given by notification published in the Gazette. Copies of such notice shall be posted at or near the grave or graves which it is proposed to re- move and copies shall be sent in a registered postal packet to the legal personal represent- ative or next of kin of the person or persons buried, if the address of such legal personal representative or next of kin can be ascer- tained. Such copies shall be accompanied by a translation in the language of the race to which the deceased person belonged, if he was not of the English speaking race. (3.) When an order is made directing the removal of any grave or graves on Crown land elsewhere than in an authorised cemetery due notice of such order shall, so far as it is possible to do so, be given to the legal personal representa- tive or next of kin of the person buried be- fore the work of removal is undertaken. (4.) The Government shall make proper and fitting arrangements for the reinterment in an au- thorised cemetery of any body or remains of a body removed under the provisions of this section and for the removal and re-erection of any monument, all charges in connection therewith being defrayed out of the public re- venue of the Colony; Provided that, when it is desired otherwise to dispose of the bodies or remains of bodies of persons of Chinese race in accordance with Chinese custom, the necessary permission shall be given, subject to such conditions, if any, as the Governor may prescribe, all reasonable expenses in connection with such disposal if within the Colony being defrayed out of the public revenue of the Colony.
91c. There shall be kept at the Sanitary Board Offices a record of every licence granted and of every order made under the provisions of the two last preceding sections. Such record. shall contain particulars, so far as the same can be ascertained, of the race, nationality, maine, sex, and age of the persons buried, date of burial and of the places of original burial and of reburial or removal. Such record shall be open during office hours to inspection by any person."
7.-(1.) Sub-section (1) of section 153 of the Principal Ordinance is hereby amended by the deletion in line of
