Repeals

section 78 of Public Health and Buildings Amendment Ordinance 1908.

there is no occupier of the premises to which such document relates by putting up the document to be served on a conspicuous part of the premises to which the same relates: Provided that if the place of business or residence within the Colony of the person to be served, or that of his agent, Le known to the person by whom or on whose behalf any document is intended to be served, every such document shall be left at such place of bu- siness or residence."

7. Section 78 of The Public Health and Buildings Amend- ment Ordinance 1908 is hereby repealed.

8. The following sections are hereby added to the Principal Ordinance and shall be inserted after section 91 thereof

91A. It shall not be lawful to exhume any body or the remains of any body which may have been interred in any authorised cemetery or in any other cemetery, burial ground or other place without a licence granted in the man- her hereinafter provided,

91B. Such licence may be granted in respect of any

body interred

(a) in any authorised cemetery by the Board under the hand of the Secre- tary and

(b) in any other cemetery or burial ground or any other place by the Governor under the hand of the Colonial Secretary,

The liccusing authority may prescribe such precautions as they may deem fit as the condi- tion of the grant of such licence, and any person who shall exhume any body or remains con- trary to this Ordinance or who shall neglect to observe the precautions prescribed as the condition of the licence for removal shall for every such offence be liable to a penalty not exceeding two hundred dollars.

Provided always that nothing herein con- tained shall be deomed to affect the right of a Magistrate to order the exhumation of a body for the purpose of holding an inquiry into the cause of death of any person.

(2.) Except in respect of a grave in an authorised cemetery for which no charge has been made no such licence shall be granted without the written consent of the next of kin of the person buried, if such next of kin can be found.

(3.) No such licence shall be granted in. respect of any grave on land held under lease from the Crown without the written consent of the Crown Lessee or his duly authorised repre- sentative."

Objects and Reasons.

The Bill proposes to effect certain further nccessary amendments in the Public Health and Buildings Ordinance, 1903.

Clauses 2 and 3. These amendments are required conse- quent on the control of market buildings now by the Sani- tary Department,

Clause 4. The words are inserted so as to clearly provide that the occupier as well as the owner is brought within the purview of the section.
