Earlier this year, in a letter to us about Hong Kong deputies to the NPC and CPPCC, the Deputy Political Adviser made a passing reference to whether Hong Kong NPC and CPPCC members might be permitted to stand for LegCo in 1995. We wondered at the time what the basis was for not allowing this, ie whether it was a constitutional or a political bar. We thought there might well be an ordinance which prohibits membership of more than one legislature. If there is such an ordinance, could you please let us have a copy?
The question arose recently in a different context when there was a possibility Lord Wilson might take up his seat in the House of Lords while still being President of LegCo. We were told there was no problem there. But it would be helpful for us, for future reference, to have the precise text and verse of any relevant Hong Kong ordinances.
