GUIDANCE NOTES FOR CASEWORKING

OFFICES IN THE UK CENTRAL AUTHORITY

1. The Home Office are working on the implementation of the Criminal Justice (International Cooperation) Act 1990. When this comes into effect later this year, the UK will be able to provide a wide range of mutual legal assistance to other countries. The Home Office has set up a unit, known as the UK Central Authority, to process requests for assistance both to and from other countries. The FCO has made it clear that we wish to be consulted about certain types of requests concerning mutual legal assistance and about requests to and from certain countries, as an early warning of cases which might be politically or diplomatically sensitive.

As you will see from the recent exchange of letters with the Home Office (copies attached), we have suggested that officials processing the requests in the Central Authority be provided with a list of countries in respect of which the FCO should be consulted. The list would require regular updating and should be classified at least restricted. would be grateful for your views, by 3 May, on whether any countries covered by your departments should be included on the list, and for any suggestions concerning the types of cases on which we should be consulted, (paragraphs 3 and 4 of my letter to Alan Harding refer).
