MUTUAL LEGAL ASSISTANCE IN CRIMINAL MATTERS

1.
As you know, the Home Office, as the UK's Central Authority, will shortly be sending out Guidelines to other countries about the legal assistance the UK can provide under the Criminal Justice Act 1990. Upon your advice (paragraph 6 of your minute to me of 1 March) the Guidelines will also be sent to all the UK's Dependent Territories.
2. I would be grateful for your confirmation that the UK's Central Authority would not be expected to deal with any requests from third countries to the UK's Dependent Territories. If any such requests were sent to the UK, should they be returned to the third country or passed directly to the appropriate DT's Central Authority? I think we should advise the Home Office to explain the correct procedure in their guidance notes for case-working officers in the Central Authority.
