TRANSFER OF UK-RELATED RECORDS FROM HONG KONG
1. I refer to your minute of 26 August which was awaiting my return to the office after two weeks annual leave.

You indicate that the Hong Kong Immigration Department have asked us what immigration records we require to be transferred. to the new Consulate General in 1996/7. You say that the records have been kept on microfilm in the past but only paper records since July 1992.

Before I can answer your question as to whether there is any legal objection to keeping only the paper records I should be grateful if you would find out whether the records concern applications relating to entry to Hong Kong or applications for entry to the United Kingdom, for example, by third country nationals in Hong Kong. It could be of course that the records relate to both sorts of application.

Before I can advise fully on the questions you pose I will need the above information. I suspect that the only legal objection to a decision to keep only paper records will depend on the limitation periods for bringing legal proceedings challenging an immigration decision. I will look into this matter once I have the information I have requested from you.
