Comments on

Privileges and Immunities Requested by the Commission

Article 3

We have suggested a few drafting changes. We have no authority under our existing legislation to grant immunity of the means of transport from search, requisition, attachment and execution which we note is an immunity under Article 22 of the Vienna Convention on Diplomatic Relations. As, we indicated during our talks in July 1993, such requisition' for the purposes of national defence or public ultility is most unlikely to take place in Hong Kong. There is unlikely to be any practical need for this immunity.

Article 7

As explained at our meeting in July 1993, we have no authority under our existing laws to grant immunity from personal arrest and detention to the Head and members of the Commission's

Office.

We have suggested some drafting changes. have no authority to grant members of the Office other than the Head, and members of their families, exemption from customs duties, taxes and related charges. The importation of motor vehicles registered in the name of the Office may be exempted from first registration tax.
