"The Consuls are not diplomatic agents. They do not have the authority of a

representative which is universally recognised to diplomatic agents" (CAVARE,

"Present International Public Law", 2nd edition, p. 33) (see also Charles

ROUSSEAU, "International Public Law", Volume IV International Relations, on

Diplomatic Agents, no 113 et seq, p. 140, and on the Consule, 166 et seq.7.

As to the problems of criminal law arising from the recourse, the new observations do not bring any new element.

The defendant can therefore only refer to his previous observations.

FOR THESE REASONS and any others to be inferred or added, by the Court of its own will if

necessary,

THE DEFENDANT CONFIRMS his previous writings concluding that the recourse should be

rejected.

Mr. ROUSSEAU writes: "That the Consul is not a diplomat, this is evidenced by the conditions in which he is appointed .....”.
