I have not told Potocki anything about the possible deal. We need to decide whether we should. We all agree with Head of Chancery's comment that this needs careful handling. Although our lawyers agreed with my assumption on 8 November that anything we told Saniman's lawyers would get back to the French Justice Ministry, Bertolas took a different line this morning: having met Saniman's lawyers with Grossman, he thought that it was not in their interests to bring in the Justice Ministry. The latter were now on our side. Saniman's lawyers appeared to have no confidence in the Justice Ministry or the Conseil d'Etat in helping their appeal. It is nevertheless possible that the Justice Ministry will still find out about the possible deal.

If we are to tell the Justice Ministry, we will need to explain why Saniman's links with Tan justify our earlier political/diplomatic pressure on them. I recommend that any approach should be to Potocki or Gaeremynck (Deputy Director of Mehaignerie's Cabinet) and should be based on the attached list of elements.

Personally, I am in favour of our making this approach. The Justice Ministry still have plenty of opportunities to cause us serious difficulties over Saniman's extradition, were they to find out about the possible deal and take it the wrong way. We would have to square our lawyers and Mr Grossman. Grateful for your views.
