EXTRADITION FROM FRANCE TO HONG KONG OF DR SANIMAN

Points to Make

- An important case for Hong Kong, it concerns the largest

fraud case ever and is a matter of wide public interest.

Hong Kong have been trying to secure Dr Rais Bin Saniman's

extradition since 1986.

- FCO Ministers fully support Hong Kong Government's efforts

to seek extradition of Saniman from France to Hong Kong.

We both share an interest in Hong Kong's stability and

economic success. Public confidence in the rule of law there

plays an important part.

Rejection by the French side of the "Recours Gracieux"

lodged in May was disappointing.

- We hope that the French side can review the Ministry of

Justice's decision not to extradite Dr Saniman. If it would

be helpful, we could send a small team of British and Hong Kong experts to Paris to discuss the matter with the Ministry

of Justice.

Understand that the UK's application to the Conseil d'Etat is the first such application on an extradition issue by a

government. No question of any desire on our part to behave provocatively merely pursuing, on behalf of the Hong Kong

Government, the only remaining form of administrative redress

available.
