The authority of Mr Rais Bin Saniman would not have permitted him either to commit the

reproached offenses which, from the point of view of the Hong Kong authorities, would constitute

criminal offenses, nor even to prevent them; at the utmost he could have, which he did, expressed

orally some concern in respect of the importance of the funds made available to BMFL.

Mr Rais Bin Saniman resigned from his office at BBMB by letter of 31st October 1983, after

having recalled in his letter of resignation:

that he had at no time taken part in the definition of the credit policy followed by BMFL;

that he had attended Board meetings of BMFL only in order to organise the funding of

loans decided by others than him;

that the Board of BBMB was systematically kept aware of the reports relating to BMFL

and the criticisms which were expressed in respect of such reports;

that during the meetings of the Board of BMFL, he only reported on the activities of the

international department of BBMB for the benefit of BMFL;

that the directors of BMFL knew very well that the loans granted by it were funded

through loans obtained locally and on the interbank market;

that he had expressed on several occasions to his superiors his concern as to the

magnitude of the loans granted by BMFL.
