1. Para 2 of TUR raised the suggestion that the Spanish decision to impose new visa requirements for BDTCs and BN (0)s was intended as a means of pressure on the UK in the context of Gibraltar.

There is no legal basis for such a connection. Gibraltar, unlike any other dependent territory, is part of the EC. Gibraltarians are therefore Community nationals and are covered by the rights of free movement of persons. HMG has stated clearly that the term "UK nationals" when used for EC purposes applies inter alia to British Dependent Territories citizens who acquire their citizenship from a connection with Gibraltar.
3.
Gibraltarians will therefore be unaffected by Spanish moves to adopt a visa regime on Hong Kong British Dependent Territory Citizens or British Nationals Overseas.
