Would you please refer to my minute of 9 November about Hong Kong's comments on Vienna's telno 334. I wonder whether you have been able to go back to the Home Office on the compromise solution put forward by Hong Kong on the returnability of BN (0)s to Hong Kong. And if so what was their answer? Also have you been able to find out about any assurances that we may have given to the Germans in 1988?

As you know the legislative Council of Hong Kong are taking a keen interest in this matter and I should like to push ahead as fast as possible. I think we should aim to get a reply to Hong Kong sometime next week. If there is likely to be any delay in sending this could you therefore please let me know.

I enclose a copy of telno 1714 which we have received giving Hong Kong's comments on Vienna's telno 334. For some inexplicable reason MVD was omitted from the distribution
list.
2. I doubt very much that the Home Office (or the Austrian Government for that matter) will accept the compromise solution put forward in paragraph 2 of Hong Kong's telegramme. As the Home office will not accept in practice that BN (O)s are returnable to Hong Kong via the UK I hardly think that they would be willing to do so in theory and thus weaken their position. However as Hong Kong has put forward the suggestion we had better obtain the views of the Home Office. I should be grateful therefore if you could put it to them.
3.
In the event that the Home Ofice reject Hong Kong's suggestion the only other thing I can think of is to have a look at the assurances, if any, that we gave to the Germans in 1988.
They may perhaps provide us with a form of words which we could use with the Austrians.

Viewed, from here, the Austrian proposals would be acceptable, but we note the views of the Hone Office in paragraph 3 of your
telno 179.
Could you consider a different approach, whereby you accept the theoretical position of BN (0)s being returnable to Hong Kong via the United Kingdom, but propose to the Austrians that, in practice, BN (0)s be returned direct to Hong kong because this will be more convenient for all the parties concerned. We will be happy to consider any assurance that the Austrians require regarding practical arrangements.
