1) Implications of the Schengen inclusion of Hong Kong on CVL.

When Schengen Convention becomes operational a new CVL will become an inescapable part of the joint arrangements. The issue of a Schengen visa will give holders the right of access to all Schengen states without control at internal borders. It follows that for these arrangements to work, there will need to be full harmonisation of standards and working practices.

2) Hong Kong's position post 1/1/96, when QMV is introduced

Up to 1/1/96 the UK will retain a veto. Thereafter changes will be introduced on a basis of QMV. Given different approach to visa regimes, likely that we shall be outvoted by partners. Commission is likely to follow closely Schengen practice, which seems likely to result in visa regime on HK.

3) Pre entry clearance to UK if Hong Kong were to be included

on a CVL

Eventually entry clearance requirement will be

extended to include those currently exempt categories, ie Students, Visitors, Working Holiday-Makers, and Returning Residents.

4) Action might we consider to preserve the status quo for HK

BDTCs

We can take action to ensure that HK is not affected during the QMV regime up to 1/1/96. Thereafter see no scope.

5) Sequence of events leading up to implementation of CVL by

QMV. Will QMV slip.

QMV date specified in Maastricht.

See no reason for this to

slip. Experience suggests that once Commission gains competence, it will seek to exercise rights sooner rather than later.
