The British Nationality (Hong Kong) Act 1990 was intended to cope with the unique situation facing Hong Kong. Anybody not acquiring British citizenship under that legislation was to be dealt with under the 1981 Act and judged against the normal criteria. The key criteria are those relating to residence in the UK and the wives and widows fail to qualify against these. There are no compelling circumstances which would warrant this policy being overturned. The Government has agreed that the wives and widows may come to the UK with a view to settlement at any time, after which they may apply for registration or naturalisation in the normal way. There is no other nationality solution short of new legislation.

Recommendation
(i) Maintain the position that citizenship cannot be granted so long as the wives and widows are in Hong Kong and fail to meet the usual UK residence requirements.
(ii) Send suitable explanatory letter to Mrs Emily Lau, Chairman of LegCo nationality sub-committee, who led the delegation to the Home Secretary on 9 June- draft attached.
