Dear Lord Willinghby,

Hong Kong Ethnic Minorities

Sorry you could not get me in the office yesterday but we managed to speak at home. I now write in answer to your fax to confirm the answers I gave you

LAST PAPER

(1)

Secure (and also not really an issue); there have been no worrying Chinese statements on this aspect.

I have checked the past legal position of the othric minsities with my colleagues. Before the coming into force of the 1962 Commonwealth Immigration Act, all Citizens of the United Kingdom and Colonies (CUKCs) had the right to enter the United Kingdom free of conditions, regardless of whether they were born in the UK or dependent territories. After 1962, CUKCS born outside UK lost that right. They could then only obtain that right by being naturalised in the UK, the requirement for which was a number of years' residence. The position was changed again when the British Nationality Act came into force in 1983.

The above is true for the ethnic minorities as well as all ethnic Chinese BDTCs in Hong Kong.

I hope this is helpful to you. I will be happy to help again if you need more information.
