Including service of Justices of the Peace under public or community service

Justices of the Peace (JPs) are appointed by the Governor under Article 14 of the Letters Patent. Appointment as a JP is not an honour awarded for past public service. A JP is required to perform specific duties, such as :-

(a)

to administer, take or receive applications, oaths, declarations, etc required under the law;

(b) to issue warrants or orders prescribed in law;

(c)

to hold offices stipulated in law; and

(d) to visit and inspect prisons, hospitals and other

institutions.

A list of the powers and duties of JPs is annexed.

In considering whether a particular organisation should be included as a public body for the purposes of the Scheme in the first phase, the Governor has taken the following criteria into account :-

(a)

they are statutory bodies, set up under the law to perform duties in the interest of the public; or

(b) non-statutory bodies appointed by the Governor or the Chief Secretary to serve the interest of the public. (Under this criterion, virtually all the more important government boards and committees with non-official members have been included.)
