You have notified posts in July through
telegram number 181 that all late applications falling outside the criteria for acceptance listed in the DSP should be referred to Hong Kong. We have now identified another point on which we need your assistance.
Those late overseas applicants whose applications the Director of Immigration rejects will have to be informed of the decision and the channel of appeal. If an applicant appeals he will have to be notified of the Governor's final decision. We have consulted our legal adviser as to who would be in a more appropriate position to inform the applicants. The advice we have is that the ultimate authority in relation to -

registration and naturalisation;
renunciation, resumption and deprivation of BC, BDTC or the status of BN (0)
rests now with the Secretary of State. Subject to confirmation from you that the Secretary of State is content for the Governor to exercise his functions in respect of these matters, the Governor may instruct the Director of Immigration to write on his behalf direct to overseas applicants. There is no need, then, for the decisions to be communicated to the Ambassadors etc. for onward transmission to applicants.
