Const. would be denied such a right. I do not see that it makes any sense for an applicant living in America to have an appeal to an appeal panel in Hong Kong.

3. As I have mentioned to you, I believe that the appeal panel should be established administratively and it should be announced that the Governor will take advice from the appeals panel when he considers late applications which the Director of Immigration has refused to accept. It follows that I do not think that it will be necessary to amend the order, unless Hong Kong wish to widen the current "special circumstances" exception.
