THE PROBLEM
Members of the Legislative Council's Nationality Sub-Committee are concerned that the phased programme for registering British Dependent Territories citizens (BDTCs) as British Nationals (Overseas) [BN(O)s] and for issuing them with BN(O) passports will deprive BDTCs of their right to apply for registration as BN(O)s before 1 July 1997, and that some will be deprived of that right earlier than others. They have also questioned whether a person registered as a BN(O) must be in physical possession of a BN(O) passport for that status to continue after the change of sovereignty.

RECOMMENDATION AND ADVICE SOUGHT

It is recommended that the Administration should continue to seek an Order in Council imposing cut-off dates for application for registration of BDTCs as BN(O)s and for registration or naturalisation as BDTCs and allowing a discretion to approve late applications, as recommended in memorandum XCC(92)187 (reproduced at Annex A), but the implementation of the programme should suitably be deferred to enable sufficient publicity to be given to the first age group after the Administration has explained further its reasons to the Legislative Council.
