In accordance with existing procedures, it would appear that if Mrs A wants to be registered as a BN(0) as well as to continue to travel on a BC passport, she has to go through the following steps:

Now,

make an application for a BN (0) passport before 1 July 1997 [or on or before the specified date if the draft Hong Kong (British Nationality) (Amendment) Order 1993 comes into force];

upon

produce her current BC passport for cancellation collection of the BN(0) passport as administratively she is only allowed to hold one type of British passport; then

apply for a BC passport again, and in accordance with para 6.1.12(14) of DSP

request the endorsement "holder of the passport is also a BN(0)" be included in this new BC passport;

produce her BN (0) passport for cancellation upon collecting her new BC passport.

even though Mrs A has not made any formal request or application for registration as a BN(0), it is not her (as well as many other people in similar situations) intention to apply for or travel on a BN (0) passport.

As we are planning to launch a phased programme to register HKBDTCS as BN (0)s later this year, we anticipate enquiries similar to Mrs A's will rise. Therefore, before we attempt to answer any of such queries, we should be grateful for your advice on the following:

(a) Is there any other way that Mrs A can be registered as a

BN(0) without applying for

for a BN(0) passport? Or are the steps described in the preceding paragraph the only way for Mrs A to be registered as a BN(0)?

According to Passport Office, Newport, the BN(0) passport that Mr Ebrahim applied for had never been issued to him but had been retained on file. However, his BC passport had been endorsed to indicate that he is also a BN (0). In such circumstances, can Mr Ebrahim be considered as having satisfied the conditions in JD 227 as well as having been registered as a BN (0) in conformity with Article 4(2) of the Hong Kong (British Nationality) Order 1986, notwithstanding that he has never been issued with or held a BN(0) passport?

If the answer to (b) is in the affirmative, should we advise people in similar circumstances to do the same instead of going through the four steps previously described?
