enacting

the Bill

has

Hong Kong Government

of Rights Ordinance in 1991,

given effect in local law to

provisions of the ICCPR as applied to Hong Kong. An

amendment to the Letters Patent was also made to ensure that

no law of Hong Kong should be made that restricts the rights

and freedoms enjoyed in Hong Kong in a manner which is

inconsistent with the ICCPR as applied to Hong Kong.

Line to take

(a) The continued application of the ICCPR is already

provided for in the Joint Declaration (JD 156) and

the Basic Law (BL 39).

(b) Details of how the UK currently

discharges its

(including the

obligations under the Covenant

obligation to report to the UN Human Rights

Committee) are under consideration in the JLG. This

help to maintain consistency after 1997. Given

confidentiality provision of JD 196, we cannot

disclose details of the proceedings in the JLG.
