US INTEREST IN THE HONG KONG/MALAYSIA ÉXTRADITION TREATY

Further to my letter of 12 January, I thought you might like to know that I have just been telephoned by John Harris, Deputy Director of the International Affairs Division of the Department of Justice. Mr Harris is in the UK on other matters but wanted to know about the death penalty provisions in the HK/Malaysia treaty. I spoke to him on the lines of paragraphs 3 and 4 of Alasdair Sinclair's Letter to me of 12 January. Surprisingly this was news to Mr Harris. I stressed that as our treaty was still only initialled, we would appreciate it if the Americans did not quote it as an example to the Malaysians. I do not know whether in the end they will follow this route, as they will probably need to make public any such exchange of letters. However if an opportunity arises I would be grateful if you could underline the sensitivity of the exchange to the Department of Justice.
