Thank you for your letter of 5 October, covering a copy paper on transfer of assets and Hong Kong's comments on it.

2. This is a very important set of issues for us. The paper is drafted in terms of the transfer of the assets of the Hong Kong Government, but of course the transfer of its liabilities has also to be achieved effectively. I understand that under the law of state succession, liabilities have the same destination as assets. This may be why your paper does not discuss liabilities explicitly. But it is obviously important that in further work the point be addressed explicitly.

3. I look forward to seeing further work on these matters in due course, in particular the draft agreement which you say your Legal Adviser is preparing. No doubt we will have a chance to review this with

you before a proposition is put to the Chinese side in the negotiations.
