Issue of receipt by Registrar

This clause will provide, based on Clause 6 of Part II of the proposed Patents Bill, that on first receipt of the documents and on payment of the filing fee the Registrar shall mark the documents with the date of their receipt by the Registrar and immediately issue to the applicant a receipt which shows a number, the nature and number of the documents received and the date of receipt.

This clause will provide, based on Clause 7 of Part II of the proposed Patents Bill, that after issue of the receipt the Registrar shall examine the documents to determine whether they satisfy the requirements under Clause 93 for the giving of a date of filing of a petty patent application.

Making good minimum requirements of a petty patent application

This clause will provide, based on Clause 8 of Part II of the proposed Patents Bill, that:

if a date of filing a petty patent application under Clause 93 of this Part cannot be given because of deficiencies, other than non-payment of the fee, the Registrar must where practicable give the applicant an opportunity to correct the deficiency within one month of being notified by the Registrar. This one month period cannot be extended. If the deficiency is not remedied within one month the petty patent application is deemed withdrawn. The fee is not refunded; and

where the deficiencies are corrected within the one month period the date on which they are lodged so as to comply with the minimum requirements becomes the date of filing of the petty patent application.
