Failure to make good deficiencies on application for grant of a HK patent

Where deficiencies are not corrected within the time set by the Registrar or within any extension of that time up to the maximum of four months, the application is deemed withdrawn and abandoned. The application may be reactivated on an application for further processing under Clause 18 made within one month of the application being deemed withdrawn and on payment of a fee.
An application for restitution of rights under Clause 19 can also be made.
17.
Grant of HK patent and publication
After the formal examination and the making good of deficiencies the Registrar shall enter details of the application in the register and shall grant a HK patent in the prescribed form and publish it. As soon as possible after it is published the Registrar will issue to the applicant a Certificate of grant in the prescribed form and advertise the fact of such grant in the Gazette.

Further processing of request to record or of application for grant of a HK patent
Where a request to record or an application is deemed refused for failure to comply with a time limit an application may be made in writing within one month of such deemed refusal for reinstatement provided the omission is made good and the additional fee is paid.
(2) Further processing is not available to applicants who fail to make good the minimum requirements under Clause 8 above.
