where there are different sets of claims for different designated countries, those sets of claims which are to apply to HK; and
whether or not an opposition is pending in the EPO and if the time for commencing such proceedings has expired.
Examination as to formal requirements and making good deficiencies on application for grant of a HK patent

(1)
The Registrar shall examine the application to grant a HK patent to see that :

(a)
a request to record has been properly made;
(b)
the date of filing the application falls within the period of six months from the date of publication of the corresponding EP patent; and

(c)
the full requirements of Clause 14(2) have been met.
(2)
If the formal requirements reveal deficiencies the Registrar must invite the applicant to remedy the deficiency in the same manner as set out in Clause 10(1).
