CPO should be aware of and understand the practicalities which dictate this choice. The Chinese will welcome the PSC's recommendation to register Chinese patents.

May 1993. The following actions, not necessarily in the order stated, will then follow -

drafting of the localized patent law and planning of administrative details for the expanded HK Patents Registry;
setting up of administrative arrangements with the UKPO to enable the HK Patents Registry to establish and maintain records of those patents registered in Hong Kong which are still valid and will continue to be protected under the proposed new system;
discussions with the CPO on technical details relating to the registration of Chinese patents in due course; and
formal JLG consultations with the Chinese side on the localized patent law.

We will be interested to hear HMG's views on the proposed changes to HK's patent law and system. particular we would like to know if there are likely to be any changes to the Patents Act 1977 and/or the subsidiary legislation to reflect the proposed GATT TRIPs agreement and the possible Harmonization Treaty so that these can if necessary be incorporated into the proposed legislation.
